1. Who We Are
Banabatau Projects (Pty) Ltd ("Banabatau Projects", "we", "us", or "our") is a CIDB-registered construction company with offices in Pretoria and Somerset West, South Africa. We are committed to protecting your personal information and handling it responsibly in accordance with the Protection of Personal Information Act, 4 of 2013 ("POPIA").

2. What Personal Information We Collect
We only collect personal information that you voluntarily provide to us. This may include:
- Your name and surname
- Email address
- Phone number
- Company name (where applicable)
- The message or enquiry you submit through our contact form
Separately from the details you type in, our website analytics record technical information automatically as you browse: the pages you open, the website or search that sent you, an approximate location derived from your IP address, and your device, browser and screen size. This is collected under an anonymous identifier rather than your name, and section 9 explains it in full, including how to switch it off.
We do not collect sensitive personal information (as defined in POPIA) and we do not collect personal information from children under the age of 18 without parental consent.
3. Why We Collect It
We collect and process your personal information for the following purposes:
- To respond to your enquiry or request for a quote
- To follow up on projects or services you have engaged us for
- To send you information you have specifically requested
- To comply with our legal obligations
We will not use your personal information for any purpose other than those listed above without your prior consent.
4. How We Use Your Information
Your information is used only by authorised members of the Banabatau Projects team to respond to your enquiry, prepare quotes, and communicate with you about services. We do not sell, rent, or trade your personal information to any third party.
Where we engage service providers (for example, email hosting or project management tools), we take reasonable steps to ensure those providers protect your information in a manner consistent with POPIA.
5. Sharing Your Information
We will not share your personal information with third parties except in the following circumstances:
- Where you have given us explicit consent to do so
- Where we are required to do so by law or by a court order
- Where it is necessary to perform a service you have requested and the third party is bound by appropriate confidentiality obligations
Two service providers process information on our behalf. Web3Forms delivers the enquiry form to our inbox, so it handles the name, email address, phone number and message you submit. Google Analytics processes the technical browsing data described in sections 2 and 9. Neither is permitted to use your information for its own purposes, and we do not sell or rent personal information to anyone.
6. How Long We Keep Your Information
We retain your personal information for as long as necessary to fulfil the purpose for which it was collected, or as required by applicable South African law. Enquiry records and correspondence are typically retained for a period of five (5) years, after which they are securely deleted or anonymised.
7. Security
We take reasonable technical and organisational measures to protect your personal information from loss, misuse, unauthorised access, disclosure, alteration, or destruction. Our staff are trained on the importance of data privacy and confidentiality.
While we take every precaution, no method of transmission over the internet is completely secure. We cannot guarantee absolute security but will notify you and the Information Regulator as required by POPIA if a data breach occurs.
8. Your Rights Under POPIA
As a data subject under POPIA, you have the right to:
- Know whether we hold personal information about you
- Request access to the personal information we hold about you
- Request correction or deletion of your personal information
- Object to the processing of your personal information
- Lodge a complaint with the Information Regulator
To exercise any of these rights, contact us at admin@banabatauprojects.co.za. We will respond to your request within a reasonable time.
9. Cookies
We use Google Analytics 4 to understand how visitors find and move through this website. It sets first-party cookies in your browser (named "_ga" and "_ga_" followed by a property ID) which record an anonymous identifier, the pages you view, roughly where in the world you are, and the device and browser you used. It also notes a few basic interactions on its own: how far down a page you scroll, clicks on links that take you to another website, and any documents you download from us. Google anonymises your IP address before storing it, and we have not enabled advertising features, remarketing or Google Signals, so this data is not used to target adverts at you.
We do not use advertising or remarketing cookies of any kind. Analytics data is retained by Google for 14 months and is never linked to the details you send us through the enquiry form.
You can opt out at any time by installing the Google Analytics Opt-out Browser Add-on, by blocking cookies for this site in your browser settings, or by browsing in a private window. None of these will stop the site working.
The two Google Maps panels on our contact page are loaded from Google and may set their own cookies when that page opens. See section 10 below.
10. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. We encourage you to read their privacy policies before submitting any personal information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Any changes will be posted on this page with a revised effective date. We encourage you to review this policy periodically. Continued use of our website after changes are posted constitutes acceptance of the updated policy.
12. Contact and Complaints
If you have any concerns about the way we handle your personal information, please contact us first at admin@banabatauprojects.co.za and we will do our best to resolve your concern.
If you are not satisfied with our response, you have the right to lodge a complaint with the Information Regulator of South Africa:
